BawarchiBuddy is a Platform as a Service (PaaS) that enables home cooks to:

• Create and manage their culinary business profiles
• Accept and process customer orders
• Manage menu items, pricing, and availability
• Process payments through various methods including UPI
• Track business analytics and performance
• Communicate with customers
• Schedule and manage deliveries

We provide the technology platform and tools, but you are responsible for the quality, safety, and legality of your food products and services.

3. User Accounts and Registration

3.1 Account Creation

To use our services, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Verification Requirements

We may require verification of your identity, business license, food safety certifications, and other documents to ensure compliance with local regulations and platform standards.

3.3 Account Security

You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.

4. User Responsibilities

4.1 Food Safety and Quality

• Maintain high standards of food safety and hygiene
• Comply with all applicable food safety regulations
• Ensure accurate ingredient listings and allergen information
• Maintain proper storage and handling of ingredients
• Obtain necessary licenses and permits

4.2 Business Conduct

• Provide accurate menu descriptions and pricing
• Honor all confirmed orders and delivery commitments
• Maintain professional communication with customers
• Resolve customer complaints promptly and fairly
• Comply with all applicable laws and regulations

4.3 Prohibited Activities

You may not:

• Use the platform for any illegal or unauthorized purpose
• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit harmful or malicious code
• Attempt to gain unauthorized access to our systems
• Engage in fraudulent or deceptive practices
• Harass, abuse, or harm other users

5. Payment Terms

5.1 Payment Processing

We facilitate payment processing through various methods including UPI, credit/debit cards, and digital wallets. Payments are processed securely through our payment partners.

5.2 Fees and Charges

Our platform fees are clearly disclosed in our pricing plans. You are responsible for all applicable taxes and fees. We reserve the right to modify our fees with reasonable notice.

5.3 Refunds and Disputes

Refund policies are subject to our refund terms and applicable payment processor policies. We will work with you to resolve payment disputes fairly and in accordance with our policies.

6. Intellectual Property

6.1 Platform Content

The BawarchiBuddy platform, including its design, functionality, and content, is protected by intellectual property laws. You may not copy, modify, or distribute our platform without permission.

6.2 User Content

You retain ownership of your content (menu items, photos, descriptions) but grant us a license to use, display, and distribute your content as necessary to provide our services.

6.3 Trademarks

"BawarchiBuddy" and related trademarks are our property. You may not use our trademarks without our written permission.

7. Limitation of Liability

To the maximum extent permitted by law, BawarchiBuddy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability to you for any claims arising from or related to these Terms or our services shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Termination

8.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

8.2 Termination by Us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for other reasons as determined in our sole discretion.

8.3 Effect of Termination

Upon termination, your right to use our services will cease immediately. We may delete your account and data, subject to our data retention policies and legal requirements.

9. Dispute Resolution

Any disputes arising from these Terms or our services will be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 2015. The arbitration will be conducted in Mumbai, India.

Before initiating arbitration, we encourage you to contact us directly to resolve the dispute amicably.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of Mumbai, India.
