1. Role of BawarchiBuddy

BawarchiBuddy currently provides a technology platform for discovery, lead generation, and order coordination between customers and home cooks.

We are not the seller of food, not a delivery service provider, and not the merchant of record for customer payments unless explicitly stated otherwise in writing for a specific service.

2. Acceptance of Terms

By accessing or using BawarchiBuddy, you agree to these Terms and our Privacy Policy. If you do not agree, you must stop using the platform.

3. Account and Eligibility

• You must provide accurate account information.
• You are responsible for all activity under your account credentials.
• Kitchen users are responsible for required licenses, permits, and food compliance.

4. Kitchen and Customer Responsibilities

Kitchens and customers are solely responsible for transactions, fulfillment, delivery arrangements, product quality, communications, and legal compliance relating to food sale and purchase.

• Kitchens must provide accurate menu, ingredient, and allergen details.
• Customers must verify dietary suitability and delivery details before ordering.
• Both parties must comply with applicable laws and regulations.

5. Payments, Refunds, Replacements, and Delivery

BawarchiBuddy does not currently collect, hold, or settle customer payments as merchant of record. Payment is made directly between customer and kitchen.

BawarchiBuddy is not responsible for delivery execution, replacement of items, or refund processing. Any refund, replacement, cancellation, or delivery dispute must be resolved directly between customer and kitchen, subject to applicable law.

We may provide support records or communication assistance but do not assume transactional liability.

6. Platform Availability and Changes

We may update, suspend, or discontinue platform features at any time. We do not guarantee uninterrupted availability and may perform maintenance or changes without prior notice.

7. Prohibited Conduct

• Fraudulent, deceptive, illegal, or unsafe activity
• Unauthorized system access or malicious interference
• Harassment, abuse, or rights violations affecting other users

8. Limitation of Liability

To the maximum extent permitted by law, BawarchiBuddy is not liable for indirect, incidental, consequential, special, or punitive damages.

Our liability for direct claims related to platform use is limited to amounts paid directly to BawarchiBuddy, if any, in the previous 12 months.

9. Indemnity

You agree to indemnify and hold BawarchiBuddy harmless from claims, losses, liabilities, and costs arising from your content, transactions, fulfillment, delivery, legal violations, or misuse of the platform.

10. Governing Law and Disputes

These Terms are governed by the laws of India. Courts in Bangalore, India will have jurisdiction, subject to mandatory legal requirements.

Before formal proceedings, parties should attempt good-faith resolution by contacting support.
